ThumbnailForge provides an AI-powered service designed to help YouTubers repackage existing video content by generating new titles and thumbnails ("Reforged Content"). The Service includes features like channel scanning, AI analysis, content generation, and potentially automated updates to your YouTube channel (features may vary based on subscription plan and beta status).

3. Beta Program

Certain features of the Service are offered as part of a beta program ("Beta Program"). Your participation in the Beta Program is subject to these Terms and any additional beta terms provided. Beta services are provided "as is" without warranties and may contain bugs or errors. We require participants to provide feedback as outlined during the application process.

4. Eligibility and Accounts

You must meet the eligibility criteria specified (e.g., during the beta application process) to use the Service. You are responsible for maintaining the confidentiality of your account credentials (managed via Clerk) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payment

Access to the Service requires a paid subscription. Fees are billed on a recurring basis as specified during checkout (processed via Stripe). You agree to provide accurate billing information. Beta pricing is subject to change upon public launch, though beta users may receive grandfathered pricing for a limited time as specified in our offer details. Failure to pay may result in suspension or termination of your access. All payments are subject to our Refund Policy.

6. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

• Violate any applicable laws or regulations.
• Infringe upon the intellectual property rights of others.
• Upload or generate content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Interfere with or disrupt the Service or servers/networks connected to the Service.
• Attempt to gain unauthorized access to any part of the Service.

7. Content Ownership and Licenses

You retain ownership of your original YouTube video content. By using the Service, you grant us a limited, non-exclusive, royalty-free license to access your YouTube channel data (via authorized APIs) and process your content solely for the purpose of providing the Service, including generating Reforged Content.

You own the specific Reforged Content (titles, thumbnails) generated for you through the Service. You are responsible for ensuring that your use of the Reforged Content complies with YouTube's Terms of Service and Community Guidelines.

8. Intellectual Property

The Service itself, including its underlying technology, software, design, branding, and aggregated data (excluding your personal data and specific Reforged Content), are the exclusive property of ThumbnailForge and its licensors.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. RESULTS FROM USING THE SERVICE (E.G., INCREASED VIEWS OR CTR) ARE NOT GUARANTEED, EXCEPT AS EXPLICITLY STATED IN OUR "FORGER'S GOLDBACK GUARANTEE" (SUBJECT TO ITS SPECIFIC TERMS AND CONDITIONS).

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ThumbnailForge SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time according to the terms of your plan.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
